Rhaid i gyrff GIG yng Nghymru gytuno ar reolau sefydlog. Mae'r rhain, ynghyd â chyfres o gyfarwyddiadau ariannol sefydlog a chynllun penderfyniadau sy'n nodi'r penderfyniadau sydd wedi'u cadw i'r bwrdd; cynllun dirprwyo i swyddogion ac eraill; ac amryw o ddogfennau fframwaith eraill, yn nodi'r trefniadau y mae'r bwrdd, ei bwyllgorau, ei grwpiau cynghori a staff y GIG yn gwneud eu penderfyniadau ac yn ymgymryd â'u gweithgareddau yn unol â hwy. Dylai'r rheolau sefydlog fod yn seiliedig ar y model a bennwyd gan Lywodraeth Cymru ac y cytunwyd arno gan Ysgrifennydd y Cabinet dros Iechyd a Gofal Cymdeithasol.

Mae Ysgrifennydd y Cabinet dros Iechyd a Gofal Cymdeithasol wedi cytuno ar ddiwygiadau i'r dogfennau enghreifftiol canlynol:

Annwyl gadeiryddion

Daeth Rheoliadau Byrddau Iechyd Lleol, Ymddiriedolaethau’r GIG ac Awdurdodau Iechyd Arbennig (Cyfansoddiad, Aelodaeth a Gweithdrefnau) (Diwygiadau Amrywiol) (Cymru) 2024 i rym ar 20 Ionawr 2025.

Roedd y Rheoliadau hyn yn diwygio Rheoliadau Byrddau Iechyd Lleol (Cyfansoddiad, Aelodaeth a Gweithdrefnau) (Cymru) 2009, Rheoliadau Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Iechyd Cyhoeddus Cymru (Aelodaeth a Gweithdrefn) 2009, Rheoliadau Ymddiriedolaethau Gwasanaeth Iechyd Gwladol (Aelodaeth a Gweithdrefn) 1990 a Rheoliadau Addysg a Gwella Iechyd Cymru 2017.

Pwrpas y gwelliannau hyn yw sicrhau cysondeb yn ymwneud â’r:

(i) gofynion cymhwysedd ar gyfer cadeirydd, is-gadeirydd ac aelodau o’r Bwrdd nad ydynt yn swyddogion / cyfarwyddwyr gweithredol
(ii) darpariaethau sy'n ymwneud â phenodi swyddogion yn aelodau o fyrddau iechyd lleol
(iii) trefniadau ar gyfer penodi'r aelod undeb llafur i fyrddau iechyd lleol
(iv) amserlenni ar gyfer cyhoeddi agendâu a phapurau byrddau a phwyllgorau

O ystyried y gwelliannau hyn, mae angen gwneud diwygiadau i'r Rheolau Sefydlog Enghreifftiol, Cadw a Dirprwyo Pwerau ar gyfer Byrddau Iechyd Lleol, Ymddiriedolaethau'r GIG ac Awdurdodau Iechyd Arbennig gan ddefnyddio pŵer cyfarwyddo Gweinidogion Cymru yn unol ag Adran 12(3), Adran 19(1) ac Adran 23(1) o Ddeddf y Gwasanaeth Iechyd Gwladol (Cymru) 2006.

Mae'r gwelliannau a amlinellir yn Nogfen 1, a ddosbarthwyd gyda'r llythyr hwn, yn disodli'r rhai a gyhoeddwyd ar 23 Ebrill 2024 ac a gadarnhawyd yng Nghylchlythyr Iechyd Cymru WHC/2024/019. Bydd Cylchlythyr Iechyd Cymru newydd yn cael ei gyhoeddi i gadarnhau hyn.

Amendments to the model standing orders and reservation and delegation of powers for local health boards, NHS trusts and special health authorities following the making of the Local Health Boards, NHS Trusts and Special Health Authorities (Constitution, Membership and Procedures) (Miscellaneous Amendments) (Wales) Regulations 2024.

The Local Health Boards, NHS Trusts and Special Health Authorities (Constitution, Membership and Procedures) (Miscellaneous Amendments) (Wales) Regulations 2024 came into force on the 20 January 2025.

These regulations amended the Local Health Boards (Constitution, Membership and Procedures) (Wales) Regulations 2009, The Public Health Wales National Health Service Trust (Membership and Procedure) Regulations 2009, The National Health Service Trusts (Membership and Procedure) Regulations 1990 and The Health Education and Improvement Wales Regulations 2017. As a result, the following amendments are required to:

Local health board model standing orders

1. Eligibility requirements

No amendments required.

2. Appointment of officer members

Section B – the local health board: membership of the local health board

Amend the highlighted text within the following paragraph, from:

1.1.1 The membership of the local health board shall be no more than 24 members comprising the chair, vice chair, non-officer members (appointed by the Minister for Health and Social Services), associate members, the chief executive (appointed by the board with the involvement of the Chief Executive, NHS Wales) and officer members (appointed by the board).

To:

1.1.1 The membership of the local health board shall be no more than 24 members comprising the chair, vice chair, non-officer members (appointed by the Minister for Health and Social Services), associate members, the chief executive (appointed by the board with the involvement of the Chief Executive, NHS Wales) and officer members (appointed by non-officer members of the board and the chief executive).

Section B – the local health board: officer members [to be known as executive directors]

Amend the highlighted text within the following paragraph, from:

1.1.3 A total of 9 (including the Chief Executive), appointed by the board, whose responsibilities include the following areas: medical; finance; nursing; primary care and community and mental health services; strategic and operational planning; workforce and organisational development; public health; therapies and health science. Executive directors may have other responsibilities as determined by the board and set out in the scheme of delegation to officers.
